my mom had a $5000.00 trust for my son and when he turned 18 she cashed it out and gave him some.
Is that legal considering my name is on the paperwork as being the one in charge of it not her.
How did she get away with that?
If the trust has provisions allowing her to do so, then it is fine. If the trust allows only you to act, then you should seek court order that she returns the money. Since she is the grantor/ person who creates the trust, it is possible that she gave herself the right to take out money.
