My mom just had a stroke

She is in the 4th stage of cancer now in the brain. I have to travel to go see her but am in need of advanced parole or something so that I can come back into the country. I have not done the 485 mailing yet. I am out of status for over 5 years but have D/S on my I-20. Do I have any options? Thank you!

Need more information to answer your question. If you are out of status, on which basis are you filing 485? If you dont have legal status in the US or leave the country without Advance Parole, you wont be able to reenter the US again. At the port of entry you will be asked for document that would entitle to enter the US. If you are not able to provide it, you will be put in removal proceeding.

Sounds like your status is F1 visa. You have not filed I-485, then you don't have advanced parole. Your option is to come back on F1 if the school agrees to your absence.
