My lease vehicle was declared a total loss after the accident. Geico insurance company agreed to pay actual cash value for the car to the leasing company minus tax, title and tag fees. My question is: By PA law am I entitle for those additional fees: tax, title and tag? And how those have to be calculated?
More importantly, you should find out if there will be any amount still due the leasing company after the payment is made.
Geico should be paying the tax; title and tag? Good question. Big issue is does your insurance or that plus gap cover the amount due on the lease? You don't want to be stuck for an overage amount (one of many reasons why car leases are tools of the devil).
If it wasn't your fault and you were injured, you want to see what your rights are by calling a member of the Pennsylvania Association for Justice. Most of us give free consultations.
If you were injured due to the negligence of another driver, a local personal injury lawyer will be able to resolve both issues. Avvo has a great lawyer finder tool to locate an attorney close to your home. Good luck.
