We have rented a 3/2 apartment in Florida. Recently we have not been satisfied with the upkeep or the neighbors. The new landlord came by for an inspection yesterday and merely questioned if were were insterest in 'renewing'. My question is, will our lease automatically transfer or can we decline to rent from the new owner. What happens with our Security deposit and last months rent? Will the new landlord be responsible for this or the old one has to reimburse us?
You always have the right to not renew
Unless you have agreed in writing in your written lease agreement that you have an obligation to send a notice ahead of time and you failed to to that.
You should read your lease to see what it says about renewing and new owner taking over.
The old Landlord is holding your money.
You should write and ask if he transferred it to the new owner or not.
If you move out and don't receive it back, send a letter to the old owner and the new owner demanding your money.
You can then sue the old owner or the new owner if they don't give the money back ....... and if they don't agree on who is holding it sue them both.
While you do not have to renew your lease, the fact that the landlord sells the property does not automatically let your out of your lease obligations. Unless your lease contains a provision to the contrary, both you and the new owner are bound by the provisions of your existing lease.
