My kids 4 years old son and my 13 year daughter are being left alone with my ex wife's boyfriend while she goes to work can I call the cops and have the kids brought to me. She has visitation rights three times out of the year.and is leaving the kids with a felon. What can i do? And I live out of state in NC and dropped them off in Fort Myers Florida Thanks, Ray
In Florida, in all likelihood the police will do nothing without a court order specifically authorizing them to pick up the child. Consult a North Carolina attorney, because pursuant to the UCCJEA (Uniform Child Custody Jurisdiction and Enforcement Act), North Carolina is the state that in all likelihood can yield power to have the children returned via a court order that would then have to be signed off by a Florida judge.
This is not a police matter. Being a felon doesn't necessarily mean he is a bad baby sitter. Driving on a suspended license can be a felony. If you have an objection to the boyfriend you need to get a lawyer and show why he should not be around your children, e.g. child abuse or sex offender. But you need to go to the county that has jurisdiction of your divorce which I assume is in North Carolina.
