My 12 year old kid was hid by the bus operated by the Beltway transportation company, lucky the bus jut hit him and he got injuries but overrun the bicycle. Which is smashed, thanks God he jumped otherwise this lady would go over him.
We took him to hospital, treatments and staff, and we submit the papers to their insurance company . They said it is his own fault and nothing could be done and we are responsible. Even the police office said it is his fault, and We told him , should the bus or any vehicle stop when the see active pedestrian on the walkaway, because as long as you see a pedestrian you can't smash him, it is just logic to which he said if the pedestrians are right all the time there would be chaos. This transportation company did not even call or apologize at list, which is not nice on their behalf.
Can I take any legal action against them?
None here can tell whether or not you can sue---an attorney would need to see the reports, understand the damages.
That said, in Virginia, an individual who has been deemed to have some degree of their own negligence in the situation will be barred from suing. Its a harsh law, only a few states still adhere to it. VA is one of them. Its called pure contributory negligence.
Fortunately he was not hurt and the only loss was a bike.
