You posted this question before. Custody focuses on parenting and the best interest of the child. If you are the better parent and have been the primary care provider for the child you stand a good chance. You want us to tell you that he is disqualified from being considered as the custodian of the child but the courts don't usually work like that. His felony and DWI won't help him win custody--but it will not be lost on the court that you have overlooked those two negatives for years. Go and speak to a lawyer in person and get advice specific to your facts which includes a discussion of parenting and who has been the primary care provider for the child.

It is unlikely that your husband for reasons of the criminal records pointed out, the pornography problem, the DWI, will be able to obtain custody of your daughter. But you need to obtain family law counsel and try to get temporary orders made for your child and possibly regarding the house. Start consulting with family law counsel.
Once you know where you are going to live after the divorce and how you will pay your bills, go ahead and divorce him. You'll win the custody battle. Just make sure that if he has a lawyer, you do too. You can't win this by yourself if he has an attorney.
