One night stand happened November 25th, 2011. Baby is supposedly due mid August. We have no contact with her except through her church. We don't have her last name. I have her phone number and first name. She pursued my husband. She saw his ring at the bar, and bought him a drink. He tried to leave and she begged him to stay. They were both at fault, but she was very persuasive. Do I have any rights when it comes to the baby? Do I have the right to adopt the baby? Or for us to fight for sole custody and she have visitations?
You will have no legal custody rights. Your husband will need to establish paternity. This can be done in a couple of different ways. Further, by statute, the mother will be the legal custodian until a court orders finds otherwise. I suggest that your husband retains an experienced family law attorney to assist in this matter.
