My husband is currently in custody with a no bail for a violation and 100,000 bench warrants for a case that got a da reject last year that wasn’t file and he has proof that he went to the court date and nothing was filed. He recently found out when he got arrested about his warrants stating that they sent a letter to our home which we never got. He’s been checking in with his PO EACH MONTH & she never got a noticed that he has warrants. He does understand when he caught the case last year he was on probation but it was dismissed. What are his best options when he gots back to court for those Charges (11370.1(A), 29800(A)(1). He recently did a county lid feb 2019 and ran all his cases Concurrent. If he wouldn’t know about this case he would have gone to the court but we never received the noticed. He’s trying to see if they can at least give him bail or let him fight this case being out of custody. We’re a low income family, we can’t afford a lawyer can we always get a pro bono lawyer?
The DA has up to three years to file charges.
