I am reluctant to sign the parenting plan even though we agree on everything else. I am not sure what I am giving up if my kids attend school in my husband’s district. He even stated that he will relocate in the same district. I just do not want to have the possibility of my kids being moved away where there is nothing I can do to stop the situation. What would my husbands reason be for wantimg to be the parent with residential priority when I am the one who is responsible for getting the children to and from school and more involved in daily activities? if you have and idea why this is stated and can advice on if this a worthwhile battle, please share your expertise. Thank you.
First, this is a question you should be asking of your attorney. If you don't have one, you should strongly consider retaining an experienced family law attorney. These are very serious issues, that will have a tremendous impact upon both you and your children. As a minimum, consider consulting with an attorney to get some basic insight on these matters. Language in a parenting plan about school registration is not uncommon. However, you need to consider the entire proposal, as a whole. It sounds as if either your husband is seeking to have the children live primarily with him, or he wants to limit your ability to move to a new school district. Of course, we cannot determine why your husband wants the children to live primarily with him - it may be related to the issue of child support, or he may just feel that the children will be better with him than you. Again, you really need the advice of counsel.
I fully agree with the other answer. Your instincts are spot on. This is a vital issue. Be sure to discuss with your attorney or retain one now.
My answer does not create an attorney-client relationship. My answer is for general information only per the AVVO guidelines.
