My landlord is a really nice guy. Too nice. Kind of a pushover in fact. I signed a lease in August and internationally left my girlfriend off the lease in case things didn’t work out. A month later she called him and asked to sign into the lease (without my knowledge or consent). In short there are two leases on this place, one with her name dates September and one with mine dated August. Now that things are not working out between us she springs on me that she’s now on the lease and is refusing to leave.
I have to imagine the lease she signed was not valid but what are my legal options at this point?
I would speak with your landlord and asked him to straighten things out with your girlfriend and explained to her that he did not have the right to add her to a lease or to write a new lease for her for the same location where you were living. Explain to him just exactly what you have explained to us, that you purposely didn't put her on the lease in case things didn't work out and that, sadly, things are not working out. If that doesn't work, you will likely have to hire an attorney. Sorry. I know we are expensive.
You are out of luck. Your girlfriend has a valid lease with the landlord and you cannot evict her. You can try to talk to the landlord about picking one of you and see where that goes. Or you could just leave and tell the landlord he's got a lease with her and not with you. Good luck.
