It is not possible to say how two different cases will be treated. If she was the principal wrongdoer and her case was dismissed yours may be as well but it depends on many facts not stated her (and best kept off a public forum).

I am a former federal and State prosecutor and have been handling criminal defense and personal injury cases for over 18 years. The above answer, and any follow up comments or emails, is for informational purposes only and not meant as legal advice.
Were you in fact charged with the theft? I would speak to your attorney and discuss the facts. If this is your first arrest, you will hopefully receive an ACD or dismissal, but there is no way to know at this stage.
It's difficult to say without more information. Several factors come into play, such as the court, the presiding judge, what was stolen, whether the store wants to press charges, etc.

I have practiced criminal law and personal injury law in New York City and surrounding counties for 14 years. The answers I provide are my opinions as to the question posed. It is not to be taken as legal advice. If you have been charged with any crime, consulting with an experienced criminal lawyer is always a good idea.
