We have joint legal and physical custody of our two boys. She told me the other day that since she has nothing left for her here (her entire family is here but uses our divorce as an excuse for everything), she's looking for a job overseas and wants to take our boys. She even told our sons that they will be moving already! So when I picked them up for my visit, they were crying and telling me they don't want to leave. My ex says she wants to have them with her 6 months and then with me 6 months. I told her that is ridiculous. How can I prevent her from taking them?
If there is a court order in place, then she has to abide by that court order. She can request a move away order, but you can also oppose that in court. This can become very complicated. I suggest that you contact a family law attorney to help you through the process.
You should file a Request for Order. If you believe it is imminent then you should file an Ex Parte or Order Shortening Time Request for Order. Move away cases are complex; you should call an experienced family law attorney.
