Hi, my ex recently moved to the border town of McAllen tx from san antonio without me knowing and took my 8 month old baby, as a father I want to be involved in my baby's life as much as I can, he is everything to me, is there anything legal I can do so she can move back so I can see my son more often ? Any advice would be greatly appreciated, thank you.
Possibly. Sounds like there is no court order in place? Hire an attorney and get a court order. Don't wait. The longer baby is there the more difficult this will be. You will end up paying child support.
This is a general Q&A Forum for discussion purposes only. Anything read here should be considered marginal information at best. Robert is right. There are many factors that need to be evaluated before any lawyer can give you an opinion on your chances. Seek and experienced family lawyer there in San Antonio now. You are already behind the 8 ball because she moved before you filed in Court. Don't get further behind.
Do you and she have any court orders in place concerning parental rights, duties, possession and visitation? Without such orders, she can pretty much move wherever she wants. Hire a lawyer and file a suit affecting parent-child relationship.
I am not intending this to be legal advice, because I don't know the particulars of your situation. Call me if you would like to discuss this or other isues.
