I took my son (17) to an orthodontic consult that my ex set up, his insurance will not cover braces if they are not medically necessary. She is insisting that they are. 3 different dentist have recommended removing two teeth and have all stated that braces are not a medical necessity. Secondly she is threatening to call because I have not ordered him Contact lenses. He has glasses already. It should be noted that I have physical custody of him, as she dropped him off on my doorstep. These threats occurred on the same day we had a court hearing, and she did not get the results she was looking for. What can I do?
Continue to do what you are apparently doing - taking care of your son. If DCF comes a knockin' (highly unlikely) let them in and tell them the truth.
I agree with my colleagues. If you have opinions that the braces are not medically necessary, no court will force you to pay for them unless you previously executed a marital settlement agreement stating that you would. The suggestion that you are doing something improper because you have not purchased contact lenses rather than glasses is ludicrous. That is entirely cosmetic and she is free to expend her own money on that if she so wishes.
This also obtains elements of foreclosure law and issues regarding conflict of interest.
