Hello. I have a few questions. Was the money "loaned" while you were living together? Or was it after you were no longer living together. Often, debts incurred while two people are living together could be construed as going towards mutual expenses. It would be a more difficult case if you were living together at the time. If you were not, then your obstacles are lack of any written agreement, and whether it was a loan or a gift. The case would come down to whom the Judge believes as to whether it was a loan or not. Did she pay back any portion of the amount? That could show an intent that it was a loan and not a gift. Do you have anything showing it was borrowed? A letter or note showing she was intending to pay you back? It would be a tough case but if you feel strongly about it, you can try to take the case to small claims court in your local courthouse.
