Other co-workers have had this happen to them as well and we are wondering if this is legal. I am assuming that I have missed out on job opportunities due to this conduct.
Torts, such as defamation, tend to cover statements made by employers / past employers to prospective employers. You may want to discover want more they are telling future employers. And you should also know what the motive is for your employer to make these statements to future employers. Is it to hurt you? Damage to your reputation is key for a defamation claim.
Of course, this may be a situation that you may want to fix yourself, e.g. you must have paystubs, paychecks, etc to show the prospective employer that you are telling the truth.
