I live in MA but was given a NH territory for Sales; for some reason they changed my living status to NH so no MA taxes have been taken out for over almost 2 years. I did not know this until I had my taxes done and my accountant told me. I am strictly commission so I would never know if they changed it because my pay is different every week. What recourse do I have with this company?
You are responsible for your state taxes. Did your employer make a mistake, maybe but their mistake does not absolve you from paying your taxes. Maybe you can talk to your employer and get some help paying the penalties and interest. Do not ignore MA. They are very aggressive in collecting taxes.
If you are a MA resident you are taxed on worldwide income. If you worked out of state where there is no liability for taxes, you should have noticed nothing was being taken out. If you are a commissioned sales person, you have many deductions that could lower your taxes. The previous answer is helpful but make sure you have someone advise you on the 2 years [you may need to amend the returns] and going forward.
