I have a 5 year old daughter who hasn't seen her father in a 16 months. He is a registered sex offender in Washington. He molested his 4 yr old niece and is no longer on probation. It runs in his family, His father and uncle are R.S.O. in Oregon, and his brother is in jail for raping a 14 yr old. My daughters father has just started taking U.A.s and is asking the court for visitation, including over night. I don't want my daughter around him. He has displayed inappropriate behavior towards my daughter, and myself. The G.A.L. who has been assigned to our case says his crime he was charged with is not a concern, but it is to me. Is there any free lawyers who can help me? He also wants part custody at a later time. I am scared of him and for my daughter's safety. Any advice?
Unfortunately , you'll need to convince the court that the GAL is wrong -- that will be very difficult to do without an attorney. There is a statute that you need to review -- ti's a lengthy statute that has teeth regarding the mandatory restrictions on visitation for those convicted of certain crimes. If the GAL is an attorney, he/she will know about it as well as the Judge. If you're not going to hire an attorney, you'll need to educate yourself as to it's application.
