They are making her pay for the repair. She just got the car and the clutch went out. She has a 3 month warranty but it doesn't cover the clutch?
If I knew what parts of the vehicle were covered by the dealer's warranty, I would be able to respond more to your question of whether you might be able to sue for the cost of a new clutch and other damages. Please post a new question. If you do sue the dealer, be sure to file the case within the statute of limitations period.

The two main ways to get some type of relief when someone gets in to a bad car from a dealer are:
1- Warranty Issues;
2- Contract/Fraud issues.
You may have either and the warranty you describe is just ONE type of warranty, an "express" or "written" warranty, but, when you get that type of warranty, you also get "other" warranties, by operation of law, called "implied warranties." It's possible that even if the express warranty does not cover this issue, one of the implied warranties does. An experienced lemon law attorney may be able to help on this issue.
You may have an issue related to the contract itself or a fraud. Again, an experienced lemon law attorney may be able to help on this issue. Most will ask for copies of all documents related to the car and a narrative as to what happened when, with the five Ws, Who, What, Where, When and Why. Most will not charge for the case review.
