i ended my relationship with the dad of my son when he was about 4 months old & my parents agreed to take care of him temporally until i bettered myself as i was taking it hard, they said in 6 months we would all sit down and talk about getting him back so it was only a verbal family agreement nothing was put on paper....it has been about 7 months now, they currently are collecting the benifit for him which im confused about , can they collect the benifit without having the mum sign anything? they contiue to refuse to give him back to me untill i live with them in waimate down south by timaru for a month, i live in christchurch with my mum and sister & have had counselling and have a job so ive bettered myself, they said if i want him back its either live there or take my dad &step mum

If you are unable to work things out with your dad and stepmother then you may need to hire an attorney in your area to get your child back. Your parents may fight this but as long as you can prove that you are "fit" to parent your child and will be able to support, feed, house, etc. him then you will most likely get custody. Remember they did step in to help you during a difficult time and your child has bonded with them so it would be best for everyone involved to try and work things out.
