The Surgeon said it was guck and gave me over the counter Systane eye drops and said to come back in a week. After being anxious all weekend, I went to another eye surgeon and he spotted the old cataract in 10 seconds and immediately had to perform surgery to extract the old cataract and put a stitch in my eye. I contacted the incompetent surgeon's staff and told them what happened to me and they said they were sorry that happened to me. That doctor has not called me and could care less.
The second eye doctor only charged me for the emergency room (no charge for the second operation for the cataract extraction) and was so good to me. I would like to know what my options .
For a matter like this, you'll want to use the "find a lawyer" feature on Avvo and search for an attorney who specializes in medical malpractice.
Your damages for the additional medical bills and surgical procedure would not be enough for a medical malpractice attorney to get involved. You can ask the first doctor to reimburse you for the ER bill.
