Your passenger was not at fault, and should get their own lawyer immediately. You could be at least partially at fault; if you are not injured, just inform your insurance company.
You need to report the accident to your insurance company immediately and let them handle the liability investigation.
Your auto insurance policy is a binding contract between you and your insurance carrier. Each and every auto policy has a clause requiring its insureds to report any accidents in a timely manner. Failure to do so within a reasonable time can lead to the insurance company attempting to deny coverage by sending a disclaimer letter and later a denial letter.
Bottom line: report the accident immediately to your auto insurance carrier.
