I am a salaried supervisor.. I am expected to stay 30 minutes past my core shift any day that we are busy. Saturdays are assigned ( I have to work a Saturday every 3rd week) and to not be "Drafted" to fill in Sundays, I have to "volunteer"... I had no chance to volunteer for my own shift because the schedule was made available to everyone after I left work that day and the opening shifts were taken. So now I am put into a "draft" for the 4-12 shifts that werent taken and still expected to work opening shift the next day. They dont let us "trade" a 7-3 shift with an employee that works the 4-12 shift but they can still "draft" me to work it? I dont think thats fair, but is it legal? Do I have to work it?
Absent a union agreement or a written employment agreement with specific terms that covers this type of situation, you are an at-will employee. Thus, absent discrimination or a violation of some other state or federal statute, the employer can pretty much do whatever it chooses. It does not sound fair, but absent a violation of a statute it is likely lawful.
Stuart's answer seems right on point. In Florida, employment is at-will is the default rule. That is to say that you can be terminated for a good reason, bad reason, or no reason at all. This may not be the end of the story, though.
The Federal Government and the Stat of Florida give workers additional rights. You can't be discriminated against based on a variety of factors (race, gender, religion, national origin, age, etc.). Your employer has to meet certain minimum criteria regarding wages and working conditions (FLSA & OSHA).
This being said, UNLESS your employer winds up paying you less than the minimum wage, has some element of an unsafe workplace, or is discriminating against you based on a prohibited category, you are employed at will.
Here's the counselor-at-law part: sometimes employers help us make a job decisions by how we are treated. As the job market loosens up into 2012, it may be a good time to take your superb skills and find a new gig. Maybe they'll even treat their employees better. Good luck.
