when I went to Court I wanted to go pro se. Because I want to save money for the appeal "de novo" that's what a lawyer told me and that only cost 3K and like 10K for DWI defense so I can do it cheaper. But then I go to Court and during trial this nice College girl real sweet starts talking about my ink, she liked my tattoos. One thing to another we ended up laughing together real cozy and nice, I got her contact info, we good. Looked like we kissing but we did not just spoke real close. But the Judge noticed and the Judge then charged me contempt, crazy! I had to pay a 500.00 fine and since i didn't have the money she said am going to jail NEXT WEEK. She postponed trial said get a lawyer! In the meantime should I date this girl liked my tattoos? She was hot. A lawyer now? No appeal then?
Much more information is needed. Talking in court,or more and it sounds like there was more, can be contempt. A de ovo appeal requires a trial below and that is the evidence on the de novo. I strongly suggest you sit down with an attorney and discuss the issues, There is up to 90 days jail on a second DWI, plus 10-90 days mandatory on the 3-40 enhanced. This is very serious.
