Situation: I am on H1B visa with my sponsoring company as A.I have approved i-140. Now I have received an offer from company B and company C. I did H1B transfer for both company B and C (almost same time). Both transfers got approved. I got approval of Company B first and Company C later (few days later). I still have not started working for any of these companies. I am planning to start working for Company B.
a) Does it matter if the approval comes for B first and C later, then I have to work for C only and not B (Latest approval sticks?) ? or the order of approvals does not matter?
i respectfully disagree and would advise this is an exception to the last action rule and consider an employer with an approved H1B I-797 would and should consider the H1B employment authorized.
The last approval is your current H1b employer. You may not work for any other employer if you were granted an extension of status for the third employer.
