My mom left no will so I know property and everything has to be split between siblings. Well my sister was living in house and had one daughter my sister has passed away. So who owns the house now.
What did your sister's Will say? Her share either goes to whoever is named in the Will, or if she died without a Will then it will pass to her heirs-at-law. You don't mention whether there are other siblings. Your niece needs to hire a probate attorney to go over all the facts so that the property has clear title.

If there is a will and it is probated, then it passes as provided in will, but if no will, then her heirs at law, which will depend on her marriage situation and number of children she has.
