There is a misrepresentation finding in the denial letter of AOS. The finding is erroneous.
What options do I have to clear this matter other than filing MTR. I have missed the MTR deadline. The case was really denied because of employer and his company.
I have a family based case which will be ready for processing in one year plus time. I would like to avoid going through the 601 waiver processing. This misrepresentation finding is the only thing that can create problems for me when I process my immigrant visa overseas.
I am leaving US within allowed time so there will be no 3/10 year bar.
I will be getting the visa through F4 category .
What is the misrepresentation finding and why is it erroneous?

It depends and you will need to speak with and retain an immigration attorney to determine the best bath for you. If you are past the 30 days your options are limited and you will not be able to avoid the I601 process simply because you would "like" to. Speak with and retain an immigration attorney to determine your options.
