I am an 18 year old male who will be 19 in less than a month. I just received an MIP after I was pulled over for my headlights. I was given an MIP because I blew a .022 and the legal limit under 21 is .02. I didn't get a DUI because as you may know that is a .08. I told the officer I had a couple sips of alcohol. I am wondering what the punishments may include, particularly if my license will be suspended. Also will my license be suspended if I get a diversion and is it likely I could be given that privilege of diversion? What is my best course of action? Thank you to anyone who replies.
The best course of action is to retain an attorney right away to assist you, if you cannot afford one, ask the court for a court appointed attorney.
Seek out a lawyer here on Avvo.com Use the find a lawyer tab at the top of the page. A diversion program will protect your record. Talk to a lawyer
This response is only a basic answer to your question and is not intended to be legal advise. It is your job to hire an attorney and to discuss the specifics of this question with him or her. I am not giving you specific legal advise and there is no attorney-client relationship created by my answer to your question. The choice of an attorney is an important decision that you must make and that choice should not be made upon adverting alone.
You can get diversion, possibly without a lawyer. Call the court ahead of your court date and tell them you would like to apply for diversion. OR hire a lawyer and find out if you have a defense to the case.
Always consult a local attorney before acting on any legal opinions or advice you find here, or on the internet, generally.
