I would really like to to quit my job. My employer is not paying on time. I am currently 3 checks behind .Checks are handing out and then bounce and cause bank charges. My boss is taking people out to dinner and buying drinks and not paying us. I am very upset and need to know my options.
You have a couple of options. First, you may quit your job and apply for unemployment benefits. Your boss may attempt to deny your unemployment benefits, but you can argue that you have been constructively discharged. After all, you are not getting paid for your work. Second, you may start a civil litigation to collect on the wages that the employer owes you.
I am not licensed in your state. However, you may want to check with the Minnesota Dept of Labor Wage and Hour Division to see if they can intercede for you. If you quit be aware your employer may charge you with a voluntary quit. It can be your word against his.
