Not sure you have a legal issue--no relevant facts posted.
NOT LEGAL ADVICE, NO ATTORNEY-CLIENT PRIVILEGE CREATED. FOR INFORMATION ONLY. DO NOT RELY ON ANY ADVICE YOU RECEIVE FROM ME OR ANY OTHER ATTORNEY ON THIS FORUM. Legal advice comes after a complete review of the facts and relevant documents and an expressed (written) agreement of representation that forms attorney-client confidentiality. Neither of these two events can occur in this forum. Mr. Rafter is licensed to practice in the Commonwealth of Virginia and the US Federal Courts in Virginia. His answers to any Avvo question are rooted in general legal principles--NOT your specific state laws. There is no implied or actual attorney-client relationship arising from this education exchange. You should speak with an attorney licensed in your state, to whom you have provided all the facts before you take steps that may impact your legal rights. Mr. Rafter is under no obligation to answer subsequent emails or phone calls related to this or any other matter.
I see multiple possible cases depending on the facts. He may have a case against the individual(s) responsible for causing the metal to fly into your body. Second, you may have a claim against the doctor who "misdiagnosed" you and told you that you didn't have metal in your body. Third, you may have a Workers Compensation claim as you are suffering injury by working with magnets. (Note, for a Workers' Compensation claim, it does not matter if it is not the fault of your employer that you are injured.)
You will definitely need to provide more facts before an attorney can give you advice as to which claims may be viable. Do not disclose additional facts on this website. Instead contact an attorney and ask for a free evaluation. The truth is that most lawyers will not charge you anything unless they can help you win.
You can find many experienced lawyers here on this website. Please note that we cannot contact you unless you contact us first.
I hope you get all the answers that you need and any compensation you deserve.
