My ex bought my kids to a therapist after I requested a forensic evaluation (For custody reasons), i was not informed nor were Kids lawyer or the courts, When kids told me they were going. After i got the info and called many time to speak to her over a few months. only a day before Cort did i get a return call with a update & introduction. The courts ordered a stop and ordered the records from them. they still have not sent them. this was months ago. My Daughter came to me and said all the questions were about me, how i live ect... she felt she was fishing for info for my ex. Is their grounds for a lawsuit?
You don't have grounds for a suit other than the underlying custody litigation. Your situation happens all the time, unfortunately. You should have your attorney (you have an attorney, don't you? You need one) have the Court enter a subpoena for the therapist's records, if one hasn't been sent already. If the therapist fails to comply, she can be held in contempt of court and potentially sent to jail (don't get your hopes up). The fact that she was probing for dirt on you is certainly admissible evidence at trial. You have a tricky situation, but one that lawyers love, because it gives them the opportunity to paint someone as the bad guy and treat them aggressively. Find one.

You stated that the court stopped the therapy and ordered records which were not yet produced. It is not yet the time to start a lawsuit since the court has done the right thing. For now, lets wait and see what happens next. Did the court appoint an attorney to represent your daughter?
