In the state of NC my mother began receiving medicaid in April to cover expenses while in a nursing facility. She is now in Hospice Home and I was wondering if I am required by law to pay her patient liability for the short time spent in the nursing facility now that she is no longer there.
After your mother's death, the state may file a claim against her estate asking for repayment, but no repayment should be required during her life. If your mother still owns her former primary residence, that will be part of her estate and may have to be used to satisfy any claim by the state. If the estate does have any property and NC files a claim, I would recommend consulting with an elder law attorney to see if there is any legal way to avoid paying the claim.
