Me and my boyfriend of 6 years plan to get married once I graduate college next year. He came here legally but his visa expired some time ago along with his passport,both expired before he turned 18. He goes to a university and gets financial aid too. I fear once we go through the proses he will be kicked out foe over staying, I'm aware there is something we can sign to adjust the status and let him wait here in the US for his green card to arrive , my main concern is his passport. He will need to show that passport at the interview and if they see that it is expired we could be denied.
I wanna know anything and everything we can do to prevent this and help us along the way. We have already spoken to an attorney but any extra help is always good.
Any advise could help us both greatly!
A US citizen may sponsor an overstay spouse by filing form I-130. The overstay spouse may file the I-485 green card application with related forms and remain in the US. A current passport at the interview and proof of status is not required. Proof of lawful admission is required.
