This is actually a divorce law question, I will change the subject area so that that you can get responses from experienced divorce attorneys.
Technically, anything that you had before the divorce is still yours, but anything after the divorce is joint. For example, if your business was worth 1 million dollars on the day you got married, then that's your separate property. But, if the business grew $50k while you were married, then that $50k is marital property. That's very simple, so in this case you'd probably need a valuation. Regarding the settlement, depositing it in a joint account may make it marital property. You really need to sit down and talk to someone that you can give more information about it. Hope I've helped.
