I have received a traffic violation for a Minor in Possession of Alcohol and an Open Container and I am 18 years old. The officer came on the on ramp on I-5 as I was pouring rum into a bottle on the way to a concert with four friends when I looked over and made eye contact. The officer pulled us over and questioned us where I was compliant and gave him the alcohol and told him that I had been drinking. Everyone else in the car had admitted to drinking as well besides the driver who hadn't had anything to drink. He came back and gave everyone else verbal warnings but gave me the ticket. I have court in a month and am a high GPA student with no prior offenses. What are my consequences going to be? What should my course of action be? Will i be able to get it deferred? How will this affect jobHow will this affect jobs, grad school, and scholarships I have? Any suggestions/experiences/advice helps.
I sympathize with you, since there are no doubt many who have done the same and received no citation. There may be due process issues relating to the officer's stop and investigation and taking of evidence, which a criminal lawyer could help sort out. However, I suspect this may be a case you will not win if you go to trial. However, it is possible that a lawyer could assist you in obtaining a diversion or plea bargain or expungement.
