I am planning to fly back to Vietnam with my family to have a wedding with my girlfriend this May there and wanted to know the best and fastest process to get her approved to come to the US. We’ve heard and are considering the K-1 visa as the best route. Can we start any paperwork now while we wait for our wedding. Thanks in advance!
It is either family petition or k visa. Will have different processing times and ability or inability to work upon entry to the US. You should consult with a lawyer.
Fiancee visas are for fiances/fiancees. If you two marry each other, then she is no longer your fiancee.
The waiting period to marry in VietNam is, I believe, a month. That is how long you must wait to marry after you have file the application to marry in Vietnam. Vietnam also has requirements that the prospective spouses get medical exams. That is, meeting the legal requirements to get married in VietNam is not a fun process.
You can check with your relatives in VN to see what the requirements are.
You should review the specific facts with your attorney to find out your legal options before you leave.
