My friend is in a problem. He was on H1b with 6th year expiring in Sep 2012. Yesterday he was laid off by his company. His wife is on H1b. So what are the ways he can extend his h1b after Sep 2012. He is planning to go on H4 and then find a company that can sponsor him for PERM and I-140. But is there anything other than that he can do to be eligible for h1b extension for another 3 years?. for eg: going on H4 for a year and then applying for H1b, joining a college to improve skills (F1 visa) or anything else. One more option is going back to home country for a year but he has a family here so that is not a very feasible option.
Any help is highly appreciated.
Whether he can change his status back to H-1B will depend on how much time he has left toward the 6 year maximum.
You should retain an experienced immigration lawyer to review all the facts and advise you accordingly.
J Charles Ferrari Eng & Nishimura 213.622.2255 The statement above is general in nature and does not constitute legal advice, as not all the facts are known. You should retain an attorney to review all the facts specific to your case in order to receive advise specific to your case. The statement above does not create an attorney/client relationship.
Specific questions that require evaluating multiple options should really be posed privately to an attorney. It's hard to answer them here. Good luck!
He might be able to recapture time to extend his H-1b BEYOND Sept. 2012. It really does require a consultation to determine if there are other options since your fact pattern is incomplete.
