law enforcement stopped and searched a "suspicious" car and found drugs in the car and on the driver. The driver was taken into custody and transported to jail. The passenger was then asked by officer if they could search his home (2 miles down the road) the passenger consented and the officer drove the car (that had the drugs in it and that belonged to the driver) to the residence to search the house. Supposedly they found more drugs in house but my question is, Why would an officer ask from 2 miles down the road to search a house that wasn't even involved and why did an officer drive this car to the house and not have it impounded? Is this right/legal?
This is Tyler. TPD is going to search anything you allow them to search. I'd want to know if there were any threats made to you by the officers to get you to comply with this search.
You need help.
If you consent to a search then it is very difficult to argue that the results of the search should be excluded from evidence. I suggest hiring/consulting with an attorney in Tyler. Good luck!
