I assume that you meant to type "SSI" backpay. It is interesting that you say "land" was bought and that you don't use the term "house" in your facts and that raises some concerns which may or may not amount to anything. IF we are truly talking about a vacant piece of property and IF you have not been using that property as your primary residence, then I have serious concerns that you might potentially have an SSI overpayment problem Hopefully, this is just your choice of words and you have been living on the property all along. Now, to actually answer your question, IF you are still on SSI and you transfer ANY land to someone else without them paying you the "fair market value," then you will likely incur a SSI transfer penalty which cause you to lose benefits for a long time (the amount of time depending on the value of the property given away and the amount that you get from SSI). I would NOT do this without first consulting an experienced local elder law attorney or an attorney experienced in public assistance benefits, like a Social Security disability attorney. find a local atty to sue him for what you are entitled to. he cannot lawfully keep it if it was from your money. as a minor, your father had a higher duty to protect your interests. you will need the trail of papers proving the payments to you, and where they were invested. general practice or estate attys likely the best at this. thanks, jay stillman
I agree with Mr. Davis. And, sincee SSA is pushing hard to find cases of overpayment to get the money back, this is a messy area. Make sure you explain to any attorney before you file suit about the land purchase with SSI - I too believe there may be an overpayment issue, and a likely criminal fraud investigation to follow.
