My L1 individual and my wife's L2 is getting expired on April 30 2015. Both our i94 is getting expired on same date. I understand that its good to file for extension together in advance. But, i want to get the below things clarified:
1. Can I file for my L1 extension before expiry and then for her L2 extension later i.e beyond L2 visa and I94 expiry date ? I read somewhere that copy of my I-129 petition will have to be submitted when L2 extension is done late.
2. What happens if by L1 extension get rejected while L2 extension is in progress. Can I still stay in US till a decision is made on L2 extension.
You may file the L1 and L2 petitions at the same time, and you may file the application to extend six months prior to the expiration of your current visas. As long as the extension is filed prior to the expiration of your current visas, you may remain lawfully in the United States. If the L1 is denied the L2 will also be denied, therefore if the L1 is denied you must both leave the country. I strongly suggest you speak with an immigration attorney.
You may file together or separately however if the L1 is denied the L2 is automatically denied as it is a derivative of the L1 and as such you would be in the country illegally while waiting on the result of an after filed L2 which will be ultimately denied.
No, you must timely file for the L-2 extension and the employer must timely file for the extension of the L-1.
