I have recently moved to VA with full custody of my children and court order allowing the move. My question is, how long must I be in VA before having my case transfered here as well?
It takes six months for a state to be come the "home state" of a child.
You can register your out of state order any time.
Upon registration, Virginia and the issuing state will be able to enforce the order.
The question arises as to which state can modify the order, Under the UCCJEA, a state that issues a custody order has continuing, exclusive jurisdiction to modify that order so long as a parent or child continues to reside in the issuing state. Even if you and the children are in Va., if the other parent continues to reside in the issuing state, Va. will not be able to modify the order.
