Hi, I just found out about 245i. my grandmother US citizen filed petition for my dad on 1994. both my grandmother and dad died but approval has been received prior and my aunties already benefited and migrated. since I am in California right now, am I able to adjust my status based on 245i or I should wait until my tourist visa expired?
I am not sure if there is a faster way to do this If I come back to my home country. priority date is March 1994. I believe the bulletin shows there is an available visa for us. I am together with my wife here and daughter.
Generally, the 245i Life Act provisions are to benefit persons unlawfully present without departure. A person lawfully in the US may adjust under INA 245 without 245i.
