Served summons and on 22 day atty filed a dismissal claiming I sued wrong company. Even if this were true shouldn't I still get judgement?
No, after the response deadline passes, the plaintiff must apply for default which gives each defendant additional time to file an answer. If at any time before default is entered a party answers or appears, the case will proceed on its merits.
