The applicant must not be likely to become a "public charge" on the government and be able to support him/herself after entry. It also depends on whether the I-140 on which the NIW is based was self-petitioned or through an employer. In addition, if there is a job offer, is it in roughly the same occupation as stated in the I-140? An affidavit of support could be helpful in some circumstances. The candidate should discuss with his or her current immigration lawyer for case specific advice.
