Student attacked professor, student charged sentenced to 5 yr. probation, time served, student is re-admitted . University allowed student back to school and university failed to contact professor. Professor found out and discovered the university has no resolution or paperwork of incident.
Assuming for a moment that the University has a duty to notify the professor, (and these facts do not establish that fact), the issue of liability would only attach if something were to happen to the professor as a direct and proximate result of the re-admission. Did the university agree to notify this professor? Was the university ordered to notify? What are the conditions of re-admission?
Based on the facts as stated, the university does not seem liable. However, if any of the assumptions the lack of facts forced this author to make are, in fact, innacurate, then the answer could be different.
