we hired a contractor that did roofs. I contacted him and he came out to my house and did an estimate. He gave me estimate that night, a written copy. called and booked the next day He was a few weeks out. When he went to start we let him know that the back porch roof was not going to be needed done because of some other work that needed to be done to it(which was originally apart of the estimate)the workers said okay Since the large portion was not done, we thought that portion would have been taken off the bill. It was not. Also when everything was said and done, he tried texting us the “new” bill which was MORE money than the original estimate. We tried asking for a new copy of the bill that was itemized. We did not receive one. Also, from the beginning we were told credit card was accepted. It was also on his company website that visa or MasterCard would be accepted. When we went to pay he said he did not have access to a credit card machine and did not accept credit card anymore. A few days later he went ahead and removed the “accepted visa or MasterCard” from his website. I have screen shot, he put a lien on our home that we were about about to sell for profit.
You would be wise to consult with a lawyer well-versed in the Michigan Construction Lien Act. You might be able to recover attorney fees and costs if the lien was improperly filed, including a possible claim for slander of title. Likewise, you should determine whether the contractor is properly licensed in Michigan. These are all matters for a competent construction law attorney in your area.
