I am alleged defendant of class A misdemeanor in Lawrence county, live in Mercer County. finger print order, prelim hearing order and Criminal Summons came in wrong name. I did not respond in person but sent certified letters to court. Now I have duplicate bench warrants from common pleas and magistrate court. Judge has received my Motions by mail but will not act or respond. I have file in In US district court for an injunction citing 5th and 14th admen. (procedural due process violations) and 4th amendment question because I should not have to identify myself to the court for motions in someone else's identity. Lawrence County Public Defenders office has been useless and is trying to chide me into turning myself in as someone else. I say why should I let DA office simply amend paperwork.
You can't deal with a case through "certified letters to court." I am confused. Either court documents are in your name, and therefore you need to appear in court and contest the charges, are they are in someone else's name, and therefore there is nothing for you to do.
At this point, you need to contact an experienced criminal attorney in Lawrence County. I am sure there are some here on Avvo.
There is no legal basis for the position that you are taking. If the evidence shows that you are the person identified in the complaint you have to respond even if they got your name wrong. Names are usually corrected at the arraignment if there is a problem. Judges do not respond to certified letters. And to cap it off a federal injunction is not appropriate in your case. Instead of continuing to screw up your case by representing yourself, hire a lawyer.
Hello Sharon, PA. Even from all the way out in CA, I can tell you that your attempts to defend this case are failing miserably. You've taken a bad situation and made it worse and now have warrants in two counties. Bravo.
