Boss has LLC set up with secretary of state as a dba #1. Boss opens business #2 by opening second bank account separate from dba #1. He only signs LLC name to business 2 as owner at bank. He does not register this second business with secretary of state. Dba #2 exists inside dba #1. If I sue boss for problem in dba#2 do I sue him individually or as llc. It seems that dba #2 may not have llc protection by way it was set up.No operating agreement.The LLC on secretary of state website only lists activities that dba #1 will provide.
