I recently got selected in H1B lottery, presumed if I get approved in few months, I would like to go to my country (Nepal) and come back to US with stamped H1B visa. I've also applied for TPS for Nepalese, can you advice me if it will be sensible to go Nepal in advance parole and apply for the H1B VISA and even if I get denied VISA for any reason, I can come back to US guarantee with advance payroll.
You need to ask your immigration attorney not a blog. The answer is you can do that after October 1.
Well... H1B is dual intent visa which means it is not subject to INA 214b. Advance parole is issued by the DHS not DOS and if valid will remain to be valid regardless of the H1B visa.
